· In 2025, Republican majorities in the House and Senate will pass the Antisemitism Awareness Act. This law directs the Department of Education to consider the broad definition of antisemitism provided by the International Holocaust Remembrance Alliance and specific examples of antisemitism, including certain criticisms of the State of Israel, when enforcing federal antidiscrimination laws.

· If the bill becomes law, colleges and universities could be required to prohibit conduct that falls within this broad definition of antisemitism. In addition, critical comments about Israel could become sufficient to find that acts of violence, discrimination, or harassment on college campuses are anti-Jewish motivated, violating federal antidiscrimination laws.

· In preparation for the anticipated passage of the Antisemitism Awareness Act and increased scrutiny from the new Congress and the incoming Trump administration, educational institutions should review their policies and procedures to consider whether changes should be made to comply with the law.
