The hearing will determine whether or not Yves will be freed pending trial and if he will be allowed to write in detail about what is happening to him including naming the complaint and the police officer who have accused him of harassment. He has no interest in naming the police officer but insists that he should be able to name the influencer who regularly publishes hateful anti Palestinian content online.

Tomorrow the Montreal police will arrest me for posting to social media against Israel's genocide in Gaza.

Today I received a phone call from a Montreal police officer by the last name of Crivello. She asked me to come to a downtown police station where I will be charged for harassment and indecent communication. Crivello said a complaint was submitted against me months ago by a legal firm on behalf of racist media personality Dahlia Kurtz. Crivello said I had described Kurtz as a "genocide" supporter and "fascist" on Twitter. Guilty as charged.

On dozens of occasions I've responded to Kurtz' racist, violent anti-Palestinian posts on X. Six weeks ago I wrote an article noting:

Amidst this ever-worsening holocaust in Gaza, the media and politicians want us to believe Canadian Jews are the real victims. In an egregious example, the Winnipeg Sun just published "Dahlia Kurtz mobilizing pushback on Canada's Jew-hate problem." Palestinian suffering is omitted from the long profile of an unhinged Jewish supremacist. The article describes Kurtz combating "'Free Palestine' hatefests" and selecting Justin Trudeau "winner of my 2024 Jew-Hater of the Year Award."

Over the past 15 months Kurtz has become a leader in Canada's fascist movement, posting incessantly about purported Jewish victimhood and the anti-genocide "mob" who should be "deported". A compulsive liar, Kurtz openly calls for state violence against those challenging Canadian complicity in genocide. On Friday she posted a video that appeared to show dark skinned teenagers fighting in Edmonton mockingly describing the incident as "a celebration of diversity". A week earlier she posted a photo of neo-Nazis rallying with the statement "'MASS DEPORTATIONS NOW' banner at mall in London, Ontario. Who's with them?"

A major paper profiling this fascist, Jewish supremacist, fifteen months into the holocaust in Gaza speaks volumes of the media climate.

On July 5, 2024, Kurtz quote tweeted me with the statement: Hello, @EnglerYves. I'm advising you in this one message only that you are harassing me. You're threatening and you're making me afraid for my safety. You must stop this harassment — and communication with me. Stop now."

She quote tweeted a message I posted six days earlier noting "Racist Dahlia supports killing Palestinian children. 20,000 is not enough she wants even more Palestinian blood spilled."

As an X user noted immediately and Kurtz surely knows, the platform has a mechanism for anyone who no longer wants to hear from another user. They can block that user. Kurtz has chosen not to block me but instead pursue criminal charges.

I've never met Kurtz. Nor have I messaged or emailed her. Nor have I threatened her. I don't even follow her on X (Twitter's algorithm puts her posts in my feed).

Apparently, the legal firm assisting Kurtz is that of Neil Oberman, who is running for the Conservative party in the upcoming federal election. Oberman has launched a slew of lawsuits in recent months against different institutions and individuals opposing genocide. On two occasions I've videoed myself questioning Oberman about his 'lawfare' at the service of Israel's genocide.

As part of releasing me from detention, Crivello is seeking to have me accept conditions that stop me from any interaction with Kurtz. As the father of a two-year-old and seven-year-old and author of 13 books, it's beyond absurd to suggest I'm a threat to Kurtz. But I am willing to sign this condition to avoid jail. On the other hand, the officer told my lawyer she wants to impose a condition for my release saying that I'm not allowed to discuss the case. That is a flagrant violation of my freedom of expression, but is presumably designed to protect the police officer, Kurtz and her legal team from embarrassment. I will refuse to sign this condition and may be detained until a judge decides if this is an acceptable condition.

Across the country advocates of genocide and apartheid have been using the legal system to protect Israel from criticism. They launch frivolous cases to suck up activists' time and resources. Too often the police and courts participate in this abuse of their authority.

Police should not be putting their services at the disposition of those promoting Israel's crimes against Palestinians. The charges against me for posting against Israel's crimes should be withdrawn.

You can't make this up. Initially the Montreal police accused me of harassing an anti-Palestinian media personality because I posted about Israel's genocide. Now they are charging me for harassing the police for writing about the charges levelled against me.

At 9:30 AM tomorrow the Montreal police are set to arrest me. Today an officer told me they will detain me overnight or until I'm brought before a judge.

On Tuesday police investigator Crivello said they were charging me at the behest of anti-Palestinian activist Dahlia Kurtz. The police officer said I had described Kurtz as a "genocide" supporter and "fascist" on Twitter, which is true.

I promptly wrote about the charges and the Canadian Foreign Policy Institute organized an email letter campaign, which saw 2,500 outraged people call on the cops to drop the Kurtz-sponsored charges. Angry at receiving emails and my article — the police were seeking release conditions barring me from discussing the charges levelled against me — the police are now claiming I'm victimizing them. Today a new investigator called to say investigator Crivello feels threatened by my writing about the charges levelled against me. The Montreal police will be charging me with intimidation, harassment, harassing communication and "entrave" (interference) towards Crivello.

The police investigator also announced that they will be holding me overnight out of fear that I may "recidive" (relapse). In other words, I might once again write about the absurd charges levelled against me. Guilty as charged.

Over the past 24 hours I've received multiple messages about frivolous cases brought against others for opposing genocide. The abuse of police and legal system to target opponents of genocide is a greater problem than I realized.

I'm trying to make sense of Kurtz's bizarre bid not to block me on X but claim I am harassing her. Perhaps she is trying to monetize her status as a victim of hate. On her site Kurtz writes: "If you want to help save Canada from hate and extremism please donate by e-transfer to: [email]. After years of working for media outlets, I am now independent, so I can say the truth. This also means my personal security is under constant threat. You can make a difference. My work is funded solely by your support."

A lawyer is looking into pursuing legal action against Kurtz. But it's the police that really need to be held accountable. The initial charges were an abuse of state authority and adding new charges for criticizing them is beyond absurd.

The Montreal police apparently have no qualms about acting in service of Israel's slaughter in Gaza. More than 100,000 have been killed and almost everyone has been displaced. About 70% of buildings are destroyed and most agricultural land damaged.

The police targeting opposition to Israel's crimes is an embarrassment. The particular charges are ridiculous. The notion that someone can publicly attack Palestinians, repeatedly call Canada's prime minister an antisemite and a supporter of terror, engage a Conservative Party candidate as a lawyer to convince police to lay charges and authorities go along with it — simply incredible. Then for the police to claim they are being victimized by emails critical of the ridiculous charges — I'm at a loss for words. What parallel universe have we slipped into?

After spending five days imprisoned, I was released without restriction on my ability to discuss the charges brought against me for criticizing Israel. It's a small win for free expression and Palestine campaigning.

In court on Monday the judge effectively forced the crown to drop its bid to block me from mentioning arch anti Palestinian Dahlia Kurtz. The crown wanted to restrict my ability to mention the name of the Jewish supremacist who instigated a police complaint against me.

The outpouring of support has been heartwarming and helpful. On Thursday morning 30 joined an emergency rally to accompany me to the police station where I was detained. A similar number showed up at court on Friday and on Monday morning I was told 100 rallied at the court. Thirty were still there when I was released after 7 PM.

Protesters' presence in the court Monday morning is probably what prompted the judge to demand the jail send me immediately to court (apparently there was a mix up on the date for my bail hearing). Those who came out ensured the judge considered the free speech/Palestine issue seriously. A slew of guards commented on the number of supporters inside court and who later waited outside for my release. As a result, they treated me more respectfully.

Pen Canada and Pen America posted messages to X about the case. On Tuesday the Canadian branch of a lobby group for persecuted or imprisoned writers wrote a letter  https://pencanada.ca/news/pen-canada-letter-to-mayor-and-police-chief-of-montreal-regarding-yves-engler/ to Montreal's mayor and police chief expressing concern regarding my arrest. Prominent international journalists Glen Greenwald, Ali Abunimah, Aaron Mate, Caitlin Johnstone and others posted or wrote about the case. Senator Yuen Pau Woo posted multiple times expressing concern about the charges. Hundreds have donated and sent messages of support.

We won the first round in this battle to suppress speech on Palestine. But it's outrageous that an author spent five days in jail to win the right to write about the person who brought charges against him. It's also scandalous the police responded to my writing about the case by claiming I was harassing them.

The crown should immediately drop all charges against me, apologize and compensate me for my imprisonment. Of course I'm not holding my breath for the system to do the right thing.

Canada supports Israel's violence and apartheid in innumerable ways. Targeting critics of Israel has long been a way Canada assists Palestinian dispossession.

I was recently arrested for social media posts critical of Israel and spent five days in jail to win the right to discuss social media influencer Dahlia Kurtz who pursued charges against me. My experience fits a long history of Canadian police and intelligence services targeting critics of Israel and includes close ties to their Israeli counterparts.

Over the past 16 months Canadian authorities have responded to the popular uprising against Israel's horrors in Gaza by greatly escalating their assaults on critics of Israel. As I've written or discussed, dozens of individuals have been jailed or had their residences raided. In the most egregious abuse of state authority, Ottawa listed the grassroots Vancouver-based Samidoun Palestinian Political Prisoners Network a terrorist organization.

While the suppression has escalated in parallel with the upsurge in activism, it's been going on for a long time. In recent decades the Canadian Security and Intelligence Service (CSIS) has demonized and targeted critics of Israel. In one of the rare cases that was publicized, at least seven friends of Stefan Christoff were visited by CSIS agents over an 8-month period in 2009 and 2010. They arrived unannounced early in the morning and asked detailed and sometimes menacing questions about the Montreal activist's work with Artists Against Apartheid or trips to the Middle East.

As Israel and the Palestine Liberation Organization (PLO) engaged in negotiations during the 1990s many Palestinian Canadians accused CSIS of intimidating opponents of the Oslo accords. CSIS allegedly offered cash in exchange for information on those opposed to the PLO's compromise. A 1994 Washington Report on Middle East Affairs article explained, "CSIS is carrying out a political agenda by targeting only those who are aligned with non-Fatah groups of the PLO — those who oppose the accord signed by the PLO. More than 20 PFLP [Popular Front for the Liberation of Palestine] supporters have come forward alleging that they have been interrogated by CSIS."

Through the Five Eyes (US, UK, New Zealand, Australia and Canada) intelligence sharing arrangement Canadian agencies have close ties to their Israeli counterparts. The Communications Security Establishment (CSE) has long gathered intelligence on Palestinians for Israel. For many years many the CSE, notes former CSE officer Mike Frost in his 1994 book Spyworld, "[former Palestinian Liberation Organization chairman] Yasser Arafat's name, for instance, was on every [CSE] key word list." According to files released by Edward Snowden a decade ago, CSE spied on Israel's enemies and shared the intelligence with that country's SIGINT National Unit. "Palestinians" was a "specificintelligence topic" of a CSE, US NSA and British GCH project shared with their Israeli counterpart.

As a number of books on Canada's intelligence agencies note, Canadian-Israeli intelligence relations date back decades. Canada's ambassador to Israel in the mid 1990s, Norman Spector, described "very close cooperation" between the Canadian and Israeli spy agencies and admitted there was a CSIS operative working for him at the Canadian embassy in Tel Aviv.

This relationship is also active inside Canada. In his 1990 book Official Secrets: The story behind the Canadian Security Intelligence Service Richard Cléroux noted, "Mossad agents are located in every major [Canadian] city, working closely with CSIS, to protect El Al aircraft and airline installations and watching PLO political activities, especially those of Arab and Iranian students. Israelis are CSIS's prime source of information on a number of suspected terrorists and spies." CSIS also passes information to Mossad. Spy Wars describes how CSIS "told him [an unnamed Palestinian] explicitly they were gathering information for the CIA and Mossad."

According to Spector, as reported in Washington Report in 1998, Mossad's relationship to CSIS "goes beyond information sharing. There are joint operations." Although Spector did not elaborate, it is public knowledge that Mossad agents have used Canadian passports to carry out numerous foreign assassinations. "A member of an Israeli hit squad that mistakenly killed a Moroccan waiter in Norway in 1973 had posed as a Canadian," reported the Canadian Jewish News. In 1974 some 50 blank Canadian passports disappeared from a vault at the Canadian Embassy in Vienna. The next year a Mossad team in Cyprus was seized "after a hotel bombing in which a Palestinian guerrilla leader was killed. The passport used by one of the Israeli hitmen had a number that revealed it to be from among the 50 stolen in Vienna."

Until 1997, the repeated use of Canadian cover by Israeli agents received little attention. That changed when Prime Minister Benjamin Netanyahu responded to a Hamas offer for a 30-year truce (relayed by Jordan's King Hussein) by trying to kill Khalid Meshal, then chairman of Hamas' political bureau. The Israeli agents, who were captured after dropping poison in Meshal's ear, entered Jordan on Canadian passports.

Spector claimed CSIS and Mossad agents met days before the attempt to assassinate Meshal. He said Ottawa wanted to cover up Israel's use of fake Canadian passports. "Canadian authorities knew, in general, that passports were being used by Mossad," Spector noted. "It was known to people at the embassy and they essentially turned a blind eye to it." According to Spector, CSIS supported Mossad missions in exchange for intelligence. "Israeli operational agents have been given to understand that the use of Canadian passports is the quid pro quo [for information on Arab immigrants]."

While Ottawa officially protested the Meshal incident, it apparently didn't affect the Mossad-CSIS relationship. A Canadian working for Mossad, Jonathan Ross explained in his 2008 book The Volunteer: A Canadian's Secret Life in the Mossad that CSIS "was sympathetic, and it was business as usual with them despite the diplomatic flap. During a liaison exchange by our [Mossad] counterterrorism officers to Canada soon after the affair broke, many CSIS members mentioned that their only regret in the whole affair was that we didn't succeed [in assassinating Meshal]."

Clearly, targeting critics of Israel is but one way Canada assists that country's multiple crimes. Canadians of conscience must press their government to end all support of this rogue state.

My 5 days in jail as political prisoner for criticizing Israel

I recently spent five days in jail for social media posts critical of Israel and police charges brought against me. It was an unpleasant, though interesting, experience that culminated in a small victory for free speech and Palestine campaigning.

On Thursday February 20 at 9:30 a.m. 30 rallied at the detention centre where I turned myself in for charges related to 'harassing' a Zionist influencer and the Montreal police. I told the crowd the charges and conditions brought against me were police and judicial harassment.

More than a dozen police were on hand to monitor those accompanying me at the detention centre. As I crossed over into the police precinct, we chanted "Free Palestine".

Two inspectors were waiting for me near the door. I was searched twice and only allowed one shirt and pant. They also made me remove my glasses, which was disorienting.

The police inspectors sought to question me, but I refused to talk. I have no problem 'incriminating' myself by speaking publicly about state/Zionist abuses, but it should serve a political aim.

Another officer asked the two inspectors if I was to be released, which is common when you present yourself to be arrested. Instead, I was sent to the detention area because the police were seeking stifling conditions for my release and wanted to punish me. There was a lot of yelling from those locked up in adjacent cells. There was nothing except for two benches and a toilet (no seat) with water fountain in the cell. I slept using my boots as a pillow. Five hours and a bad oatmeal cookie later I appeared before a judge by video. The Crown objected to my release, so I was sent back to my cell where I exercised and played imaginary football with a cup. They gave me another oatmeal cookie and bad cheese sandwich. Around 7 p.m. a bunch of us were given our jackets, handcuffed and sent to the Bordeaux prison. Initially, the paddy wagon induced a sense of claustrophobia and it was cold. A man next to me and someone in the wagon ahead repeatedly yelled for heat, which made for a bizarre experience. It was nice to have my first conversation in 10 hours with a Newfoundlander related to former NHL player Michael Ryder, who I played with briefly when I tried out for the Hull Olympiques in the Quebec Junior Hockey League.

After 40 minutes we arrived at the prison. There was lots of waiting to be sent to our prison wing, but I got my glasses back, which was a relief. The strip search was a novel experience.

I was sent to a minimum security, transitional wing of the prison with about 15 bunkbeds. There was no clock and the phones were broken, but there was a TV in an adjacent eating area that we had access to during most of the day.

Immediately I found a small pencil, which allowed me to write. I had to guard it closely though and spent lots of time trying to sharpen it. Paper was difficult to find.

Friday morning a handful of us from the wing I was in were taken to an area of the prison to appear before court by video. A belligerent unhoused 67-year-old I was chatting with was slapped hard by a young tough guy from another area of the prison. I sought to diffuse the situation, but the testosterone filled young man got mad at me, setting the stage for the slap and the removal of the older individual by the guards.

Returning to my wing after a second video court appearance knowing that I would be there for at least 72 hours more without any guarantee of winning my fight over a bail condition infringing on my right to discuss the charges against me was difficult. Some of what transpired in court confused me and I regretted not having done more to prepare the political response to my incarceration.

Some writing and conversation with other inmates cheered me up. On Friday night I slept relatively well, considering the circumstances and Saturday morning the sun blazed through the window, so I spent an hour stretching with my shirt off and pants rolled up. It was quite pleasant.

A seventy something man in the wing defecated in his bed that night. At one point the individual, who had serious physical and mental needs, put his diaper on top of his pants. I don't know why he was there, but it was a flagrant failure of the system not to provide him with physical and mental care.

Over Friday and Saturday there were two other low-level fights that led to two individuals being expelled from the wing. Some of the guys with me were individuals who'd been abused growing up and were abusing their partners.

On Thursday at the detention centre, I was told I would be able to talk to my lawyer when I arrived at the jail. Not true. During the video hearing Friday morning my lawyer had to step out of court so we could discuss the case together. In response to a request from my lawyer the judge mandated the prison to ensure I could talk to my lawyer to prepare for the bail hearing Monday. I asked repeatedly over the weekend about speaking to my lawyer and finally at noon on Sunday a guard said I needed to fill out a form, which I immediately did. As they locked us in the bed area at 5 p.m. on Sunday I challenged the guards on access to my lawyer and a guard told me he hadn't even passed my form on to his superior.

On day five of my incarceration, I was supposed to appear before a judge. At 7:30 that morning I asked the guards when I would be sent to the Palais du Justice but was told my court appearance was the next day. I protested but what can you do. Three or four hours later I was hurried out of the wing to be taken to the court downtown. Apparently, with the court room filled with my supporters the judge called the prison to ask why I wasn't there for my case (it was apparently a bureaucratic error).

From Thursday at 9:30 a.m. until Monday at 7 p.m. I got 20 seconds of fresh air (two short walks to and from the prison wing where I was incarcerated). Prison is dehumanizing. It's confusing not knowing the (often arbitrary) rules and order of things. While there's some comradery and solidarity among prisoners, the guards are generally hostile.

At the end of April, the court will begin hearing the charges against me (unless the Crown does what's right and drops the charges). I strongly doubt that a judge will find me guilty of either harassing Zionist influencer Dahlia Kurtz or a police inspector. Even if they do, would I get more than five days in jail as a sentence? I doubt it. But if for some reason I was jailed for a month or two for social media posts criticizing Israel and exposing police abuse, so be it. It would be a small price to pay for opposing Canada's complicity in genocide. And very little compared to what Palestinians have endured for decades.

Reflections on my arrest and lessons learned

An extreme Jewish supremacist activist convinced the police to arrest me for criticizing her racist posts. She's likely acting as a front for a vast Zionist 'lawfare' initiative hostile to embarrassing Canadian leaders.

Over the past 16 months I've annoyed many among the Jewish Zionist establishment. My writing, social media commentary and reporting on protests have circulated widely. But it's a particular type of social media journalism/activism that's had the widest impact.

Around two million watched an interview I did with the mayor of the Montreal suburb Hampstead, Jeremy Levi, in which he said he was okay with Israel killing 100,000 Palestinian children because "good needs to prevail over evil". As with some of the other interventions, my post was reported on by the Montreal Gazette and international media such as RT and Middle Eastern Monitor. Many also watched my exposing Anthony Housefather, Mitch Garber and Heather Reisman as genocidal Jewish supremacists. Over 10 million watched a video I did mocking a McGill rally promoting genocide.

At the end of April, I questioned lawyer Neil 'cancel man' Oberman who has instigated over a dozen injunctions or legal threats against opponents of genocide, including the Palestine encampment at McGill university. (Oberman's 'lawfare' is part of a vast legal effort in service of genocide detailed recently in a Canadian Jewish News article explaining that "CIJA's new legal task force is suing the federal government, universities and school boards to 'make people behave'.") Subsequently, Oberman yelled at me in court. At that point I was on 'ban who I can' Oberman's radar and he assisted extremist Zionist influencer Dahlia Kurtz.

In early July Kurtz, a woman happy to play Jewish victim, retweeted a message I posted a week earlier in a threatening manner, suggesting some police or legal campaign was planned. She wrote Hello, @EnglerYves. I'm advising you in this one message only that you are harassing me. You're threatening and you're making me afraid for my safety. You must stop this harassment — and communication with me. Stop now." (I responded, "I'm advising you in this one message to stop promoting Israel's holocaust in Gaza. Stop now.")

While she accused me of "harassment" for responding to her racist and violent messages on X, Kurtz didn't block me as others say she's done to them. I've never met, messaged or threatened Kurtz and don't even follow her on X.

In the summer the police investigated Kurtz's claims against me. After deciding there wasn't sufficient evidence to press charges they closed the file. But, when Oberman sent a legal letter on Kurtz's behalf in mid-December the file was reopened (I assume Oberman assisted Kurtz from the get-go).

Kurtz's allegations against me have broad personal and political implications. Finding me guilty of harassment for simply responding to her racist, violence promoting, messages would set a negative precedent. Snarky, biting, political statements in response to genocidal supremacism is a low bar for harassment. It would grant some legal legitimization to Zionist tears/victimhood or what a recent meme labeled the "Am Yisrael Cry" phenomenon.

At a personal political level if I "harassed" Kurtz then the legal system might also find I've "harassed" a slew of other (mostly non-Jewish) political figures with my journalism/activism/commentary. I've attended or interrupted a dozen press conferences with Steven Guilbeault. I live in the environment minister's riding and have bumped into him on the street and at the Biblioteque Nationale. If I've "harassed" Kurtz than I've definitely "harassed" Guilbeault.

The situation is similar for Montreal Mayor Valerie Plante who also happens to swim at the community centre near my home. Ditto for foreign affairs minister Melanie Joly and Prime Minister Justin Trudeau, who've I've challenged many times in person and on X. Housefather also has a far greater claim against me than Kurtz since I've challenged him on numerous occasions and responded with the same type of hard hitting, snarky, commentary to his (albeit less directly) racist and violence promoting posts.

Levy, Garber, Melissa Lantsman, B'nai Brith, Centre for Israel and Jewish Affairs and many other pro genocide accounts have blocked me on X. I haven't created any ghost account to continue responding to their genocidal Jewish supremacism. I do everything in my name and am proud of my commentary, writing and activism. Similarly, when I attend press conferences to question politicians, I employ my own name.

Challenging a political system promoting war, inequality and climate breakdown is the least we can do. Canadian support for Israel's genocide has exposed the rot of Canadian foreign policy.

Now that I've had some time to reflect on my arrest, incarceration, experience with the legal system, and outpouring of support, another lesson has been learned. Every time Zionists employ police-state methods to shut down criticism of Israel more people understand what Palestinians face daily.
