FBI interviews loom for Clinton, aides, says report

  "The FBI is arranging interviews with some of Hillary Clinton's closest
   aides over her use of a private email server while serving as secretary
   of State, a new report says
   
   Prosecutors are also expected to seek an interview with the Democratic
   presidential front-runner herself, though nothing has been scheduled so
   far, according to the Los Angeles Times.
   
   No dates have been set for questioning Clinton's advisers either, but a
   federal prosecutor in recent weeks has notified their lawyers that such
   meetings are pending, according to the Times report.
   
   It cited two people familiar with the probe, adding that the timing for
   speaking with Clinton remains unclear.
   
   The email controversy has dogged Clinton's campaign even as she has
   moved closer to winning the Democratic nomination. The report on the
   FBI's push for interviews suggests its probe will continue for weeks,
   making it more likely the issue will not be resolved before the end of
   the primary.
   
   "The interviews are critical to understand the volume of information
   that they have accumulated," said James McJunkin, former head of the
   FBI's Washington field office.
   
   "They are likely nearing the end of the investigation and the agents
   need to interview these people to put the information in context. They
   will then spend time aligning these statements with other information,
   emails, classified documents, etc., to determine whether there is a
   prosecutable case."
   
   Clinton's rival for the Democratic nod, Sen. Bernie Sanders (I-Vt.), has
   not used the email issue as an attack line. But in a general election, it will
   surely be used by the Republican nominee.
   
   Clinton has said it was an error in judgment to have the private server
   but has argued she did nothing illegal and that no classified material
   was sent over the server.
   
   The FBI formally confirmed that it was investigating Clinton's private
   email server in a letter released early last month.
   
   FBI records official David Hardy told a federal court last Friday that
   his agency has since had few interactions with Clinton or her
   confidants during its investigation of her email server.
   
   The Justice Department granted immunity earlier this month to a former
   State employee who helped Clinton build her personal storage device.
   Bryan Pagliano has agreed to work with the FBI in exchange for not
   facing any possible criminal charges, according to a law enforcement
   official on March 2.
   
   Critics says Clinton's use of the server at State prevented
   accountability of her tenure there and may have exposed sensitive
   national intelligence to bad actors.
   
   She has since given State approximately 30,000 emails from her time in
   office detailing her work as the nation's top diplomat.
   
   Another trove roughly the same size, which Clinton maintains documented
   personal information, was deleted.

Judicial Watch: Obama Administration Withholds Draft Whitewater Indictment of Hillary Clinton

  Draft Indictment Bears on 'Mrs. Clinton's honesty, credibility, and
   trustworthiness ... for the position she currently seeks.'

   
   (Washington, DC) – Judicial Watch announced today that it is asking a
   federal court to order the National Archives and Records Administration
   to release draft criminal indictments of Hillary Clinton.  In its
   motion for summary judgment, the National Archives claimed that "the
   drafts involve a significant [Clinton] privacy interest that is not
   outweighed by any public interest...." In its March 11 opposition brief,
   Judicial Watch counters that allegedly "making false statements and
   withholding evidence from federal investigators bears on Mrs. Clinton's
   honesty, credibility, and trustworthiness ... for the position she
   currently seeks," rendering the National Archives claim "neither
   serious nor credible."
   
   These developments stem from an October 20, 2015, Judicial Watch
   Freedom of Information Act (FOIA) lawsuit (Judicial Watch v. National
   Archives and Records Administration
(No. 15-cv-01740)) seeking:
   
      All versions of indictments against Hillary Rodham Clinton,
      including but not limited to, Versions 1, 2, and 3 in box 2250 of
      the Hickman Ewing Attorney Files, the "HRC/_ Draft Indictment" in
      box 2256 of the Hickman Ewing Attorney Files, as well as any and
      all versions written by Deputy Independent Counsel Hickman Ewing,
      Jr. prior to September of 1996.
   
   The draft indictments relate to allegations that Clinton provided false
   information and withheld evidence from federal investigators to conceal
   her involvement with the defunct Madison Guaranty Savings & Loan, the
   collapse of which lead to multiple criminal convictions.  Clinton
   provided legal representation to Madison Guaranty as an attorney at the
   Rose Law Firm in Little Rock, Arkansas.  Clinton's Rose Law Firm
   billing records, long sought by prosecutors, were found in the private
   quarters of the White House shortly after an important statute of
   limitations had expired.
   
   In its motion for summary judgment, the National Archives confirmed
   that it has located the Clinton draft indictments, stating, "Included
   among the records of Mr. Starr and his successors are drafts of a
   proposed indictment of Hillary Rodham Clinton." It adds, "Box 2250
   contains a folder labeled 'Draft Indictment.'  Box 2256 contains a
   folder labelled 'Hillary Rodham Clinton/Webster L. Hubbell Draft
   Indictment.' Multiple drafts of the proposed indictment of Mrs. Clinton
   were located by NARA [National Archives and Records Administration]
   within these folders."
   
   The National Archives claims that Clinton's right to privacy supersedes
   the public interest concerning the draft indictments.  It also claims
   that the release would violate grand jury secrecy protections and that
   Mrs. Clinton has 'a strong interest in not being associated
   unwarrantedly with alleged criminal activity.'
   
   The National Archives asserts:
   
      While there may be a scintilla of public interest in these
      documents since Mrs. Clinton is presently a Democratic presidential
      candidate, that fact alone is not a cognizable public interest
      under FOIA, as disclosure of the draft indictments would not shed
      light on what the government is up to.
   
   Judicial Watch counters that the public interest in finding what Mrs.
   Clinton was up to in the White House is paramount:
   
        [A]t the time Mrs. Clinton was being investigated by the
      independent counsel for making false statements and withholding
      evidence from federal investigators, she was First Lady of the
      United States.  The alleged false statements and withholding of
      evidence also allegedly occurred while Mrs. Clinton was First Lady
      of the United States. The D.C. Circuit has found that, as First
      Lady of the United States, Mrs. Clinton was an officer of the
      United States, at least for purposes of the Federal Advisory
      Committee Act....
     
        Obviously, making false statements and withholding evidence
      from federal investigators bears on Mrs. Clinton's honesty,
      credibility, and trustworthiness, not only as First Lady, but also
      in her subsequent government service as a U.S. Senator and U.S.
      Secretary of State and for the position she currently seeks ... The
      Archives' assertions to the contrary are neither serious nor
      credible.
   
   In its opposition brief, Judicial Watch also notes that when it comes
   to any grand jury secrecy, "there is no secrecy left to protect:"
   
      Finally, enormous amounts of grand jury information about the
      independent counsel's investigation of the First Lady have already
      been made public and are widely available. The relevant section of
      the January 5, 2001 Final Report [by the independent counsel] –
      which, again, the D.C. Circuit approved for publication and which
      is readily available on the Government Publishing Office's website
      – cites to, references, or quotes testimony from at least 25 grand
      jury appearances by 21 witnesses between 1995 and 1998... Once
      published, independent counsel reports effectively eliminate grand
      jury secrecy. Similarly, the 206-page "Summary of Evidence"
      produced by the Archives to Judicial Watch pursuant to a separate
      FOIA
request also discloses even more grand jury information.
   
   In response to a separate Judicial Watch FOIA investigation, the
   National Archives released 246 pages of previously undisclosed Office
   of Independent Counsel internal memos revealing extensive details about
   the investigation of Hillary Rodham Clinton for possible criminal
   charges involving her involvement with Madison Guaranty, including the
   infamous Whitewater/Castle Grande land transaction.  The memos are
   "statements of the case" against Hillary Clinton and Webster Lee "Webb"
   Hubbell, Hillary Clinton's former law partner and former Associate
   Attorney General in the Clinton Justice Department.  Ultimately, the
   memos show that prosecutors declined to prosecute Clinton because of
   the difficulty of persuading a jury to convict a public figure as
   widely known as Clinton.
   
   "It is absurd for the Obama administration to argue that Hillary
   Clinton's privacy would keep a draft indictment from the American
   public," said Judicial Watch president Tom Fitton.  "One can't help but
   conclude that the Obama administration is doing a political favor for
   Hillary Clinton at the expense of the public's right to know about
   whether prosecutors believed she may have committed federal crimes."

'One shot at the queen': FBI, AG intensify focus on Clinton email probe

  "As the FBI enters the final phases of its investigation into Hillary
   Clinton's use of an unauthorized email server for government business,
   Attorney General Loretta Lynch and FBI Director James Comey are meeting
   frequently to discuss the progress and handling of the highly sensitive
   case, a source told Fox News.
   
   Among the issues discussed in the meetings, which have been taking
   place several times per week, are who will be interviewed and in what
   order, according to an intelligence source close to the ongoing case.
   Emails released by the State Department have already shown Clinton and
   several key aides used the personal, unsecured network to send more
   than 1,000 messages which have been deemed classified.
   
   "In a case like this you get one shot at the queen," the source, who
   was not authorized to speak on the record, said referring to Clinton,
   the former secretary of state and current front-runner for the
   Democratic presidential nomination. "The pressures are enormous on the
   agents, as the case has to be airtight and perfect."

   Comey and Lynch are likely involved in daily briefings on the status of
   the explosive investigation, said Ron Hosko, former assistant director
   of the FBI's criminal investigative division.

   The investigation into Clinton's private email server is reaching a critical point, according to sources.
   
   "This in an incredibly high stakes, high-wire act," Hosko said. "Timing
   is of the essence, but being right is absolutely critical. Comey must
   be the one to make the case that the law has been broken and a
   prosecution is recommended."
   
   Nearly a dozen people who worked with Clinton at State, as well as
   others linked to the Clinton family's nonprofit foundation have
   received, or are expected to receive, formal interview requests from
   the bureau, the source told Fox News. The Los Angeles Times reported
   Sunday that the FBI was setting up interviews with Clinton's closest
   associates and would likely seek an interview with her.
   
   "The authority for these formal interview requests by the Bureau is
   granted by the Attorney General," the source added.
   
   The formal interview requests are now being rapidly organized to set a
   time, date and place for the individuals to speak with federal agents
   about how their names have surfaced in the FBI's ongoing criminal
   investigation. The interviews would not require any statements under
   oath, and subjects could decline them.

   FBI Director Comey wants to make sure the case is airtight, according to a key source.
   
   As the interviews evolve, the FBI, as first reported by Fox News last
   fall, will explore possible violations of Criminal Code section 1001,
   which covers "statements or entries generally," and can be applied when
   an individual makes misleading or false statements that cause federal
   agents to expend additional resources and time. Legal experts, as well
   as a former FBI agent, told Fox News Section 1001 could apply if
   Clinton, her aides or attorney were not forthcoming with FBI agents
   about her emails, classification and whether only non-government
   records were destroyed.
   
   High-profile names convicted of violating Section 1001 include Martha
   Stewart, as well as former CIA Director David Petraeus.
   
   Clinton recently insisted to Fox News' Bret Baier during a town hall
   that neither she nor her lawyers have been formally notified that they
   are targets of an FBI investigation.
   
   "Absolutely not," Clinton said.
   
   But such formal notification typically comes at the end of a process
   that sometimes spans months or even years of investigation, and even
   then only if it is determined that a subject's activities likely merit
   prosecution.

   Former Clinton campaign staffer and State Department information
   technology specialist Bryan Pagliano, who installed Clinton's private
   server, was granted immunity by the Justice Department and is
   cooperating with the FBI.
   
   "His importance as a witness cannot be underestimated," a source told
   Fox News.
   
   Pagliano has first-hand knowledge of who held and used accounts on the
   server from Clinton's dealings in politics, philanthropy and private
   enterprise.  Understanding how these worlds intersected is "causing
   rats to leave the ship and others to sweat blood," said the source.

   Who was doing what while getting paid by whom is key to the ongoing
   criminal probe, as the FBI's No. 1 priority is ferreting out public
   corruption. Putting the pieces together is a challenge for federal
   investigators and investigative journalists.
   
   Key Clinton aide Huma Abedin told the State Department in a July 5,
   2013, letter that, "in addition to my work for the Department of State,
   I performed work for three others."
   
   Those jobs included working during parts of 2012 and 2013 for the
   Clinton-allied firm Teneo Holdings, which paid Abedin $105,000 even as
   she earned another $135,000 as a State Department "consultant." Teneo,
   which was founded by longtime Clinton insider Doug Band, "advised
   clients on communications and investor relations for 10 different
   merger and acquisition deals worth a total of over $60 billion,"
   according to Fortune magazine.

   In the same letter, Abedin stressed that "it is my understanding that
   Teneo does not conduct business with the Department of State. I also
   was not asked nor did I provide insights about the Department, my work
   with the Secretary or any government information to which I may have
   had access."
   
   The Clinton Foundation, founded in 1997, before President Bill Clinton
   left the White House, was renamed the "Bill, Hillary and Chelsea
   Foundation" six weeks after Hillary Clinton left the State Department
   in February 2013. Abedin worked for the foundation before and after it
   was renamed.
   
   Critics, including Republican lawmakers, have suggested that Clinton
   may have used her influence as Secretary of State to reward donors to
   the foundation, which Hosko believes is an aspect of the email
   investigation.
   
   "I am certain the FBI is looking at the nexus of State and the business
   of the foundation enrichment," Hosko said. "Is there a shell game being
   played out on a global grand scale that creates a challenging paper
   trail?"
